PERLINDUNGAN HUKUM TERHADAP TENAGA KERJA KONTRAK DITINJAU DARI ASPEK PEMBERIAN JAMINAN SOSIAL (STUDI DI PT. MULTI WIRAJAYA MULIA)

Abstract


Labor force is important factor for employer and the important factor to
determine the performance of nation. Labor force as a executor development have to be guaranteed the right, arranged obligation and efficiency development. Looking at from labor point of view, manpower law expected can give protection for permanent employee and also contract employee. It can see from three aspect they are: 1) economical protection, 2) social protection, and 3) technical
protection. The protection to the employee even permanent employee or contract employee gave in the term of social. Contract employee mean arranged in ministerial regulation number: PER- 03/MEN/1994 about the implementation of social guarantee for the daily free land
employee, contract work employee. The most important purpose from this research is to know the realization of social guarantee to the contract employee in PT Multi Wirajaya Mulia as law enforcement and to know the support factors and realization abstract contract employee right in social guarantee field. The method which is used for this research is jurisdiction sociologist which is considering law as social phenomenon with structural approaching and generally qualificated (quantitative). Based from the result the realization of giving the contract employee social guarantee which is do by polibag company PT. Multi Wirajaya Mulia has done, it just only the giving of social guarantee hasn?t fully appropriate with the regulation like in  ministerial regulation number PER/03/MEN/1994.
