TINJAUAN YURIDIS SOSIOLOGIS PERLINDUNGAN HUKUM BAGI ANAK JALANAN YANG BEKERJA DALAM SEKTOR INFORMAL (Studi di Kabupaten Jember)

Abstract


Street children are complex phenomena, since children who became worker nowadays get increasing. Child tend to relate with parents tradition to train child so that they learn to respect and responsibility, also introduce them to the working world. The problem studied in this thesis are: What factors caused children work in informal sector. How the law application for street children. How the government effort in law protection application for street children who worked in informal sector. The research used socio-juridical approach. Data source used primary and secondary data. Data collection technique used library research and interview with street children as respondents in Jember Residence. Observation and documentation, was done directly at Jember Residence Government, especially social department to take data about street children. The result then analyzed in descriptive qualitative way. From the research, there could be found that the factors caused children work were economic and non-economic factor, to help parents fulfilling the family?s daily life. Law protection for street children were by training to develop mental thought pattern of street children. Jember Residence government effort to reveal inhibitions in law protection for street children were family enforcement, child prosperity, child enforcement and temporary house. Factors caused children lived in street and worked in informal sector was caused by economic factor. That?s why Jember Residence Government, especially Social Department gave training and enforcement to Street Children to reduce the amount of street children at Jember City. We should care about street children and increasing the training to reduce their amount.
